จากกรณีเมื่อเวลา01.00 วันที่ 16 ก.พ. 60 เว็บไซต์ของราชกิจจานุเบกษา เผยแพร่ คำสั่งหัวหน้าคณะรักษาความสงบแห่งชาติ ที่ ๕/๒๕๖๐ เรื่อง มาตรการให้อำนาจกำหนดพื้นที่ควบคุมเพื่อเพิ่มประสิทธิภาพในการบังคับใช้กฎหมาย โดย พล.อ.ประยุทธ์ จันทร์โอชา หัวหน้าคณะรักษาความสงบแห่งชาติ ลงวันที่ 15 ก.พ. 60
ทั้งนี้คำสั่งระบุให้ ให้วัดพระธรรมกายตลอดจนพื้นที่รอบวัดพระธรรมกาย ในอ.คลองหลวง จ.ปทุมธานี รวมถึงพื้นที่ หมู่ 7 หมู่ 8 หมู่ 9 หมู่ 10 หมู่ 11 หมู่ 12 และหมู่ 13 ในต.คลองสอง และพื้นที่หมู่ 7 หมู่ 8 และหมู่ 9 หมู่ 10 และหมู่ 11 ในต.คลองสาม อ.คลองหลวง จ.ปทุมธานี เป็นพื้นที่ควบคุมตามคำสั่งนี้
นายวิษณุ เครืองาม รองนายกรัฐมนตรี กล่าวถึงกรณีคำสั่งหัวหน้าคสช.ที่ออกตามมาตรา 44 ประกาศพื้นที่วัดพระธรรมกายเป็นพื้นที่ควบคุม แต่ยังคงมีผู้เข้าไปปฏิบัติธรรมภายในวัดพระธรรมกายได้หรือไม่ว่า การไม่ปฏิบัติตามคำสั่งหัวหน้าคสช.จะมีความผิดตามคำสั่งดังกล่าว และพระราชบัญญัติอื่น ทั้งนี้คำสั่งฉบับดังกล่าวไม่ได้ออกมาเพื่อกรณีวัดพระธรรมกายเพียงอย่างเดียว สามารถใช้กับการก่อปัญหาที่อื่นได้ด้วย เพื่อไม่ต้องไปประกาศสถานการฉุกเฉินหรือกฎอัยการศึก เพราะเป็นมาตรการที่เบาที่สุดในภาวะปกติ แต่ในคำสั่งดังกล่าวระบุให้เริ่มใช้กรณีแรกกับวัดพระธรรมกายและพื้นที่ใกล้เคียงเท่านั้น ส่วนพื้นที่อื่นไม่เกี่ยว แต่ถามว่าเมื่อไรจะไปใช้กับพื้นที่อื่นนั้น ก็ต้องตอบว่าจนกว่าจะมีคำสั่งของกรมสอบสวนคดีพิเศษ (ดีเอสไอ) หรือ รมว.ยติธรรม สั่งอีกครั้ง
ผู้สื่อข่าวถามว่า การตรวจสอบทรัพย์สินในพื้นที่วัดพระธรรมกายจะใช้กฎหมายใด นายวิษณุ กล่าวว่า ใช้กฎหมายอื่น เช่นพ.ร.บ.ป้องกันและปราบปรามการฟอกเงิน ซึ่งได้ใช้แล้วตั้งแต่คดีสหกรณ์เครดิตยูเนี่ยนคลองจั่น ส่วนการตรวจสอบทรัพย์สินของวัดพระธรรมกายนั้นตนไม่ทราบคงต้องให้หน่วยงานที่เกี่ยวข้องดำเนินการ
